ice-' has failed thus far to explainhow the llawaiinns have been de-
prived of ati elective franchise whichthey never had, or how they canhave inherited rights which none oftheir progenitors oi predecessorsever possessed." 1 think it wouldhave been more in keeping with thetotio of the Advertiser on the noblevote, to havo wiittcn instead of theabove, something like the following:"In the matter of the native vote fori.obles, 'Justice' has failed thus farto explain how tho llawjiiians havebeen deprived of an elective fran-chise which they never had, norever shall have if wc can help it."
If the editor of the Adveiliscrwould have peace, and desires toallay all strife between the nativesand their friends (more particularlyon the part of the natives), in thisfranchise matter, he should dTscardall such weak phrases as "progenitors" and "predecessors" (it is toothin), nnd stiike out manfully for amuch lower franchise for the na-
tives. Then he will show his desirefor peace here and good will to man.It will be well for him to rememberthat the natives from Riihau to Ha-
waii know, and he knows, why andwherefore the unfortunate nativeswere "winged" in the vole for No-

Where the defendant, as masterof a packet running to California,had conveyed a debtor of the plain-tiff out of the kingdom, without apasspoit, as required by Sec. C51 ofthe Civil Code, and for justificationpleaded that he had no knowledgeof the indebtedness, nor of thedebtor being on board:
Held, that unless a careful dili-
gence had been shown, such as thothorough and faithful seaich of thevessel, previous to pussing theboundaries of the jurisdiction of thekingdom, the master, under the pro-

The liability of the master of avessel for the debts of passengersdeparting this kingdom withoutpassports, attaches when he has cou-eye- d
them across the exteiior lineof the exclusive jurisdiction on tothe high seas.
If a person be taken on board,beyond such boundary, with thepreconcert and complicity of themaster, or anyone under his com-mand, said collusive acts beingprior to passing the limit of exclu-sive jurisdiction, such conveyingaway of the debtor would be a viola-tion of the law, (Sec. 051, CivilCode) and the legal liability wouldbe the same.

ACCOUNTS.
Where one of several part ownersof the ship or ships, engaged in thewhaling business, acts as agent topurchase supplies and outfits forthe ships from third parties, he willnot be permitted to take beyond areasonable compensation for his ser-vices (or that agieed upon), norto hold any profits incidentally ob-
tained in the execution of his duty,even if sanctioned by usage.
Where said part owner had fur-nish-
the supplies for the saidvessel from his own stock in tradeat the lowest market rates, with theknowledge of and without objectionby the other owner, the latter mustbe held in law to have waived hisright to open up the accounts ofsaid disbursements, they havingbeen furnished him according to theusage of the business.
When said part owner, acting forthe others, luniislicd them, fromtime to time, with accounts of thedisbursements, and charged intereston advances made by him in fittingout the vessels, without having firstmade a demand for contribution.Held That the furnishing of theaccounts must be regarded as noticeto the said part owners and equiva-lent to an express demand, render-ing them liablo for inteicst from thetime the accounts weieso furnished.
Although agents arc not legallyentitled to any incidental profits,arising fioni the management of thebusiness confided to them by theirprincipals, yet, wheie it appearedthoy had exercised due diligence inmaking their contracts of frcight-mciit- s,
