Instrucciones para la consulta de los casos de jurisprudencia

La presente obra también facilita al profesional la búsqueda de los fallos y laudos que respondan mejor a las cuestiones que deba resol-ver.

Se han transcripto todos los fallos insertos en las colecciones CLOUT (español) y UNILEX (inglés) hasta la fecha y los autores se comprome-ten a la actualización de la obra a medida que sea necesario.

Supongamos que una parte deba determinar si la Convención so-bre Compraventa Internacional de Mercaderías (Viena, 1980), es o no aplicable al asunto que debe resolver y al mismo tiempo evaluar si los incumplimientos de una de las partes revisten o no carácter de incumplimiento esencial, en los términos del art. 25 de la Conven-ción o si el incumplimiento es o no excusable bajo los parámetros del art. 79.

Para ello buscará entre los fallos y laudos aquí citados, todos los enumerados en los artículos en cuestión 1º, 25 y 79 o cualquier otro que estime aplicable.

En el índice se indican cuáles son los casos correspondientes a cada artículo de la Convención y que constan bajo la denominación:

“Colección CLOUT”

“Número correspondiente a la colección Clout, tratados en cada artículo de la Convención”

Y a la inversa, cuando se conoce el número del caso pero no se co-noce en qué artículo ha sido reseñado, puede verse un segundo índice llamado: “Indice de los casos de la Colección CLOUT citados” que indi-ca a qué artículo de la Convención es aplicable un resumen CLOUT.

Esto en lo referente a los casos reseñados en español en Clout.

Pero esta obra presenta también un listado completo de senten-cias y laudos ordenadas en orden cronológico insertos en la Colección UNILEX.

Una vez determinado el número del caso “CLOUT”, muchas ve-ces al pie del caso se repite la fecha del fallo y un contacto o link de UNILEX. Los casos CLOUT, se encuentran en español. Los casos re-señados en UNILEX, están en inglés. El link señalado remite siempre al resumen o Abstract del caso. El link del Abstract permitirá acceder on line al Full text, en el supuesto de que las circunstancias particu-lares del caso permitan inferir su utilidad para el asunto profesional a estudio.

A partir del artículo 2, al pie de página, se indican los fallos rela-cionados a ese artículo que han sido transcriptos en los artículos pre-cedentes para evitar repeticiones. Como usualmente un mismo re-sumen comprende diferentes cuestiones, v. gr. competencia, rechazo oportuno de las mercaderías, plazos para hacerlo, etc., se ha hecho la transcripción del resumen en más de un artículo. Esta circunstancia se manifiesta en la cita entre paréntesis del artículo correspondiente en la enumeración de los resúmenes UNILEX.
