Sr.Presidente:Como sabe, las autoridades gibraltareñas llevan desde 1963 dirigiéndose a este Comité con laesperanzadeconseguirsuayuda.Esosuponemásdemediosigloplanteandonuestrosargumentosparaelreconocimientodenuestroderechoalaautodeterminacióny,enparalelo,deseandounaconvivenciapacíficaconnuestrovecino,España.Tras mi discurso el año pasado, su distinguido antecesor, su Excelencia el Sr. Diego Morejón Pazmiño, respondió a la referencia que hice al silencio continuado de este Comité en torno a lacuestióndeGibraltar.ElSr.MorejónPazmiñoseñalóquemisugerenciadequeelComitéestabafracasandoencuantoaladescolonizacióndeGibraltarerainjustayqueustedesdebíanatenerseestrictamentealosmandatosdelaONU,"noasussimpatíasporunouotrolado".ElSr.MorejónPazmiñoreconocióquetalvezeranecesariorevisarcómoestárealizandosutrabajoesteComité,peroindicóqueestodebíaacometersesiguiendoloscaucesadecuadosdentrodelaONU."Nopodemosimprovisar",afirmó.Pues bien, yo le puedo afirmar con total confianza, Sr. Presidente, que usted tiene suficientecompetenciaparacomenzaraayudarnos,talcomoleexigenlosartículos73y74delaCarta1ylaDeclaraciónsobrelaconcesióndelaindependenciaalospaísesypuebloscoloniales,aprobadaporlaAsambleaGeneralenvirtuddelaresolución1514(XV)del14dediciembrede19602,asícomoelrestoderesolucionesconexas.Todos los años venimos aquí y les recordamos que estas resoluciones les obligan a actuar paraprotegernuestroderechoalaautodeterminaciónyeliminaranuestranacióndelalistadeterritoriosnoautónomos.Todoslosañoshemosabordadotodasycadaunadelaspartesdelosdocumentosquetratandelaeliminacióndelalistadeterritoriosnoautónomosydeladescolonizaciónendiscursoseruditosydoctospronunciadospormisdistinguidosantecesores.Pero todos los años, en lugar de ver cómonos protegen, en lugar de ver cómonos apoyanparahacernosavanzar,esteComitéysussucesivosPresidentessiguendespachándonosconunabsolutosilencio.Cuentosinceramenteconqueustedvaacambiarestadinámica,Sr.Presidente,porquehayalgoqueno debe olvidar: los ecos del silencio de este Comité resuenan a lo largo de generaciones degibraltareñosalosqueseleshanegadosuderechoasalirdelcolonialismodejurequehacemuchotiempoquedejaronatrásdefacto.Elsonidodesusilenciohabladeunaorganizaciónqueyanoesadecuadaparasufinalidadoriginaria,unaorganizaciónqueyanoescapazdecumplirlasfuncionesparalasquesecreóenunmundomásduroperomuchomás idealista,eneseperiodoapasionanteenelquehemospodidovercómo la

poblacióndelosterritoriosnoautónomossereducíadesde750milloneshastaapenas2millonesdepersonas3.EsellogrodeesteComité,Sr.Presidente,peroparaesos2millonesdenosotrosqueseguimosenlalista,tambiénessufracaso.Susilencio,yesoesquizálomásdecepcionante,soncantosdesirenaparalosquedeseandaraltrasteconlosprincipiosfundacionalesdelaCartaylaDeclaraciónenundañinointentodecrearunanuevadoctrinaenelDerechointernacionalquetratealosterritoriossujetosaunadisputadesoberaníadeformadiferentealosterritoriosquenoloestán.Loterribleesqueesteintentoestáconcebidoparaacabarconlosderechoshumanosinalienablesdelos2millonesdepersonasquesiguenperteneciendoalalistadeterritoriosnoautónomos,quesonexactamentelaspersonascuyascircunstanciasplanteanloscomplejoscasosparalosquesecrearondichosprincipios.YelhechoesqueelcasodeGibraltarsehabríaresueltoynuestranaciónhabríasalidodelalistahacetiempo, de acuerdo con la Cuarta Opción para la descolonización, si no fuera por los reiteradosintentosdebloqueodelGobiernoespañol.Sr.Presidente,Españaesunanaciónqueduranteestosúltimos50añossehatrasformadoenelplanopolíticoentodoMENOSensuactitudhaciaGibraltar.DEBE desconfiar, Sr. Presidente, de una nación de 48 millones de personas con una extensiónterritorialdeMÁSDE500.000KMCUADRADOSqueempleatantaenergíacomoEspañaenintentarcolonizarnuestrosqueridos6kmcuadrados,quesonelhogarde30.000gibraltareños.ElmeollodelacuestióneslainsostenibleinsistenciadelGobiernoespañolenque,aunqueGibraltar,ensuopinión,essindudaunterritoriocolonial,losgibraltareñosnosomosunpueblocolonialynopodemoshacerusode losderechosyproteccionesqueconsagranparadichospueblos laCartayotrosprincipiosdelDerechointernacional.Obviamente,elargumentohaceaguasentantospuntosdehechoydederechoquecasinomerecelapena gastar tiempo en enumerarlos, pero símerece la pena señalar que desde el punto de vistajurisprudencial,esunaabsolutacontradicciónqueelGobiernoespañolvengaaesteComitéapedirlesqueabordenladescolonizacióndeun"territorionoautónomo",comositodoloqueimportarafueraelestatusdelterritorio(físico)encuestión.El hecho es que los principiosmismosque subyacena las normasy reglas creadaspara regir ladescolonizaciónnosonnormassobretransmisionesdepropiedadinternacionales.Nosonnormasqueserefieranalapropiedaddelosterritorioscomoparcelasdeterreno.SonnormasdiseñadasparaprotegerloquesedescribeenlaCarta,laDeclaraciónylasresolucionescomolosderechosinalienablesdelospuebloscoloniales.Son,pues,derechosqueserefierennoalosterritorios,sinoalaspersonasquevivenenellos.

Porlotanto,elGobiernoespañoldeberíatenerclaroquelosasuntosquesetratanenesteComitésobre descolonización son exclusivamente los derechos in personam (personales), que son losderechosindividualesdelospueblosdecadaunodelosterritoriosincluidosenlalista.Ynosotros,elpueblodeGibraltar,somosinnegablementeunpueblocolonialporelsimplehechodequesomosLApoblaciónnoautónomadelterritorioincluidoenlalista.Ynocabenmásargumentos,porqueinclusolapropiacategorizaciónbasadaensiunterritorioesonoun"territorionoautónomo"esclaramenteunareferenciaa laestructuradegobiernosocialycomunitariodelaspersonasqueviveneneseterritorio.La ideade laqueparteelplanteamientodelGobiernoespañolesqueel territorioyelpueblodeGibraltarson,dealgunamanera,disociables.Sinembargo,cuandosenosincluyóenlalistadeterritoriosnoautónomos,comopasóhace68años(en1946),latierraylapoblacióndecadaunodelosterritoriosseconvirtieronenalgoindisoluble,unidoparasiemprealejercerlapoblaciónsusderechosinpersonam(personales)enunterritoriosobreelqueeranlosúnicosqueteníanderechosinrem(reales)envirtuddelaCarta,laDeclaraciónylasresoluciones.Elmomentodelacristalización,enelqueelpueblocolonialyelterritoriosefundieronjurídicamenteenuno,fuecuando,en1946,elReinoUnidonosincluyóenlalistaylaONUnosaceptócomopartedeella.Dicho de otro modo: lo que la doctrina jurídica internacional pública de la ONU ha unido paraprotegerlosderechosydeseosdelospuebloscoloniales,ningúntercerestadopuedesepararloya.Porque ustedes, como Comité, se constituyeron como guardianes de los derechos deautodeterminacióndeunpueblo.Ustedesnosonunforopara laconsecucióndereivindicacionesterritorialesirredentistasdeterceros,comoEspaña.Poresemotivo,QUEQUEDECLARO,SR.PRESIDENTE,queNOTIENENCOMPETENCIAparatomarenconsideraciónlasdeclaracionesyreivindicacionesespañolassobrenuestroterritorio.Sinembargo,¡esoesloquehacenenrealidad!PerotodoeltiempoquepasenintentandoinventarnuevasdoctrinassobresucompetenciaparatratardisputasdesoberaníanuncadesembocaráenunanuevanormadeDerechointernacionalque,dealgunamanera,permitaaEspañaabrirunapuertatraserayhacerseconlasoberaníadeGibraltar.Seacomofuere,voyatratardeexpresarlodeformamássencilla:EstecomiténofuecreadoenlajerarquíadelasNacionesUnidasnienDerechointernacionalcomounórganoconcompetencianipotestadparadirimirdisputasterritoriales.EslaCorteInternacionaldeJusticia(CIJ)laqueestáahíparaeso.Pero, comoustedes sabenyhemos repetidohasta la saciedad, lasbravatasdelGobiernoespañolnunca han llegado hasta el punto de elevar a la Corte Internacional de Justicia las cuestionesterritorialesqueaudazmenteexponenaquí.Ustedestendríanquerecomendarlesquelohicieran,porquecomoelexcelentísimoSr.JoeBossanolesdijoenFiyielmespasadoduranteelexitososeminariosobredescolonización,losargumentosespañolesde1964ylosde2014noalbergandiferenciaalguna.

ElGobiernoespañolnosehamovidounápice,peroelbuquedeGibraltarhazarpadoyEspañatienequeaceptarlo,asumirloyavanzar.Inclusoentérminos físicos,estamosviendo losmismosproblemasen la fronteraconEspañaquevivimosen1964.Ese año, España comenzó a imponer restricciones en la frontera internacional entre nuestrasnacionescomopartedeunapolíticadeclaradaparaintentarestrangularloseconómicamente.En 2014, cincuenta años después, y a pesar de que los dos países formamos parte de la UniónEuropea,usanlosmismospretextosparaobstaculizarlosflujosdeentradaysalidaenlafrontera.Estas acciones constituyen sanciones económicas de facto que obligan a miles de trabajadoresespañolesahacercoladurantehorasantesdepodervolverasuscasasenEspaña,despuésdeunlargodíadetrabajoenGibraltar.EnunacartaenviadaporelViceministroPrincipal, elDr.García (quemeacompañahoy),hemosinformadoaestecomitéyalCuartoComitésobrelasmedidastomadasporEspañaylasreiteradasincursionesilegalesdelosbarcosdeesteestadoenlasaguasterritorialesdeGibraltar,vulnerandoasílaConvencióndelasNacionesUnidassobreelDerechodelMar.España obliga a madres, niños, ancianos y enfermos a hacer cola durante horas debido a unoscontrolesalospeatonesinnecesariosyesporádicos.Noexisteunajustificaciónposibleparasusacciones,nisiquieralasmásexageradasinquietudesentornoalasdiferenciasdepreciosenalgunosproductos.Gibraltar también sufre el fenómeno de las importaciones no declaradas, pero todos nuestroscontrolessonproporcionadosyestándiseñadosparanocausarmolestiasalaspersonasquecruzanlafronteraentrenuestrospaíses.Altomarmedidasdesproporcionadas,Españaperjudicaalasempresas,dañaelcomercioyenvenenalas relaciones humanas. España provoca que la vida de las familias esté llena de tensiones paraaquellosquetienenquecruzarlafronteraparairatrabajaroverasusseresqueridos.CasitodoslosdíasvemosbuquesdelEstadoespañol,desuArmadaodelaGuardiaCivilhaciendoincursionesilegalesennuestrasaguasterritoriales,¡algoqueespeorahoraquehace50años!Nomecabelamenordudadequealgúndía,algúnGobiernoespañolmásmodernovolverálavistahaciaestoscomportamientosyloslamentaráprofundamente.EstasmedidasnocontribuyenenabsolutoamejorarlareputacióndeEspaña,quebuscaconvertirseenmiembrotemporaldelConsejodeSeguridad.Asíque,examinemosquépuedenhacerustedesparaayudarnosenvirtuddelaCarta,laDeclaraciónylasresoluciones.Sr.Presidente,ustedsíquetienecompetenciaparavisitarGibraltar,lasnormasselopermiten.ElReinoUnido,la"potenciaadministradora"ensucuriosaytrasnochadaterminología,lehainvitado.Nosotros,elpueblocolonial,lehemosinvitadoenrepetidasocasiones.

MrChairmanAs you know, Gibraltarian leaders have been addressing this Committee – in hope ofyourassistance–since1963.That isoverhalf a centuryofputtingour argument for recognitionof our right to selfdeterminationand– inparallel ‐ ofdesiringpeaceful co‐existencewithourneighbour,Spain.After my address last year your distinguished predecessor, His Excellency SnrDiego Morejon-PazminorepliedtomyreferencetothisCommittee’scontinuedsilenceontheissueofGibraltar.He said that my suggestion that the Committee was failing on Gibraltar’s decolonisation was unfair and that you have to adhere strictly to UN mandates, “not on your sympathies for one side or another.” Sr Morejon-Pazmino recognised that perhaps there was a need to review how the Committee went about its work, but he said it must be done through the proper UN procedures. “We can’t improvise,” he said.Well, I can confidently tell you Mr Chairman that you certainly have sufficientjurisdiction tostartassistingusasyouarerequired todobyArticles73and74of theCharter and the Declaration on the Granting of Independence to Colonial Countries and Peoples Adopted by General Assembly resolution 1514 (XV) of 14 December 1960 and the rest of the underlying resolutions.

Every year we come here and remind you that these oblige you to act to protect ourrighttoselfdeterminationindelistingournation.

Everyyearwehaveaddressedeverypartofeachoneof thedocuments thatdealwithdelisting and decolonisation in erudite and learned speeches from my distinguishedpredecessors.

But ‐ every year ‐ instead of seeing ourselves protected by you; instead of seeing yousupport us in making progress we continue to be treated by your Committee undersuccessiveChairmentoadeafeningsilence.Isincerelyhopeyouwillseektochangethatimpasse,MrChairman.Because youmustmakenomistake : The soundof this Committee’s silence resonatesthrough the generations of Gibraltarianswho have been denied their right to emergefromthedejurecolonialismthatwehavelongagoescapedfromdefacto.Thesoundofyoursilencespeakstoanorganisationnolongerfitforpurpose;nolongerabletodischargethefunctionsforwhichitwasestablishedinaharderbutmuchmore

idealisticworldintheexcitingtimesthathaveseenthenumbersofpeoplelivinginlistedterritoriesreducefrom750mtojustover2m.ThatisthisCommittee’ssuccess,MrChairman;andalso–inthe2mofusthatremain‐itsfailure.Becauseperhapsmostdisappointingly,thesoundofyoursilenceisasirencalltothosewho wish to thwart the founding principles of the Charter and the Declaration in aperniciousattempt to createanewdoctrineof international law that treats territoriessubjecttoasovereigntydisputeinawaythatisdifferenttothosethatarenot.Terrifyingly,whatthatisdesignedtodoistodoawaywiththeinalienablelegalhumanrights of the 2m who remain in listed territories – exactly the people whosecircumstancespresentthehardcasesforwhomsuchprinciplesarecreated.And the fact is thatGibraltar’s casewouldhavebeen resolved andournationdelistedlong ago in keeping with the Fourth Option for decolonisation if it were not for theSpanishGovernment’srepeatedattemptstoblockit.MrChairman,Spainisanationthathaspoliticallytransformedeverythingaboutitselfinthese50yearsEXCEPTforitsattitudetoGibraltar.You MUST be very wary, Mr Chairman, of a nation of 48m people with a territorialextensionofOVERHALFABILLIONSQUAREKILOMETRESthatexpendsasmuchenergyasSpaindoesinordertoseektocoloniseourbeloved6squarekilometres;thehomeofthe30,000Gibraltarians.The crux of the matter is the Spanish Government’s unsustainable insistence thatalthoughGibraltarisintheirviewdefinitelyacolonialterritory,theGibraltariansarenotacolonialpeopleable toavailourselvesof therightsandprotectionsavailable tosuchpeoplesintheCharterandinotherprinciplesofinternationallaw.Thatargumentisofcoursefactuallyandlegallyfatallyflawedatsomanylevelsitalmostisn’tworthspendingtimecounteringit.Butitisworthpointingoutthatitisactuallyjurisprudentiallyentirelycontradictoryforthe Spanish Government to come to this Committee to ask you to approach thedecolonisationofa“non‐selfgoverningterritory”asifallthatmatteredwasthestatusofthelandinquestion.The fact is that the very principle underlying the rules and norms created to governdecolonisationarenotrulesofinternationalconveyancing.Theyarenotrulesthatrelatetotitletotheterritoriesaspiecesofland.They are rules designed to protect what are described in terms in the Charter, theDeclarationandresolutionsasinalienablerightsofcolonialpeoples.

These are therefore rights that relate not to territories but to the people that inhabitthem.ItshouldthereforebecleartotheSpanishGovernmentthattheissuesbeingconsideredinthisCommitteeondecolonisationareexclusivelytherights inpersonamthatarethepersonalrightsattachingtothepeopleofeachoftheterritoriesonthelist.Andwe– theGibraltarianpeople ‐areundeniablyacolonialpeoplebydintof the factthatweareTHEnon‐selfgoverningpopulationoftheterritorythatislisted.Fullstop.Becauseeventheverycategorisationbasedonwhetheraterritoryisorisnot“non‐selfgoverning”isclearlyareferencetothesocialandcommunalstructureofgovernanceofthepeopleofsuchaterritory.TherugonwhichtheSpanishGovernment’sargumentisbasedisthattheterritoryandthepeopleofGibraltararesomehowdivisiblefromeachother.Yet,onceincludedonthelistofnon‐selfgoverningterritories–aswewere68yearsagoin1946–thelandandthepeopleofeachoftheterritoriesbecomeindistinctfromeachother; joined foreveras thepeopleexercise their inpersonamrightsover theterritoryoverwhichtheyaretheonlyonesgrantedrightsinrembytheCharter,theDeclarationandtheresolutions.Themomentofcrystallisation–inwhichcolonialpeopleandterritoryareforeverlegallyfusedasone‐wasthemomentin1946thattheUKlistedusandtheUNacceptedusontothelist.Inotherwords:WhatUNpublic international legaldoctrinehas joinedinprotectionoftherightsandwishesofthecolonialpeople,nothirdstatecannowputasunder.Because you as a Committee are set up as guardians of the rights as a people to selfdetermination. Youarenota forumfor theprosecutionbyany thirdparties–suchasSpain–oftheirirredentistterritorialclaims.Forthatreason,LETUSBECLEARMRCHAIRMAN,whatyoudoNOThavejurisdictiontoentertainisSpain’sassertionsandclaimsoverourterritory.Yetthatiswhatyouactuallydo!And any time spent trying to invent new doctrines about sovereignty disputes beingrelevanttoyourworkwillneverresultinanynewruleofinternationallawthatmightsomehowallowSpainabackdoortowardsthesovereigntyofGibraltar.Iwillinanyeventputitmoresimplythanallthat:

This committee is not established in the hierarchy of the United Nations or ininternationallawasabodycompetentorempoweredtoresolveterritorialdisputes.ItistheInternationalCourtofJusticethatisthereforthat.But – as you know and we have repeated ad nauseam – the Spanish Government’sbravadohasneverextendedtoelevatingtheterritorialmatterstheyboldlyarguebeforeyoutotheICJ.Youshouldtellthemtodoso.Because,asthedistinguishedHonourableJoeBossanotoldyouinFijilastmonthduringthesuccessfuldecolonisationseminar,theSpanishargumentsof1964andthoseof2014actuallydifferinnothingatall.TheSpanishGovernmenthaven'tmovedon.ButtheGibraltarshiphassailed.AndSpainneedstoworkthatout,dealwithitandmoveon.EveninphysicaltermswearenowseeingthesameproblemsatourfrontierwithSpainaswesawin1964.AtthattimeSpainstartedimposingrestrictionsattheinternationalfrontierbetweenournationsaspartofthestatedpolicyoftryingtostrangleuseconomically.In2014–fiftyyearslaterandnowdespitethefactthatwearebothpartoftheEuropeanUnion–theyusethesametrumped‐upexcusestoimpedetrafficflowacrossthefrontier.These are de facto economic sanctions which force thousands of Spanish workers toqueueforhoursbeforereturninghomeafterahardday’sworkinGibraltar.Ina letter fromtheDeputyChiefMinister,DrGarcia (whoaccompaniesmetoday),wehave informed this and the 4th Committee of Spain’s actions and the repeated illegalincursionsofherstatevessels intoBritishGibraltarTerritorialWaters inbreachof theUnitedNationsConventionontheLawoftheSea.Spain makes mothers, children, the old, the infirm queue for hours as a result ofunnecessarysporadicpedestriancontrols.There isnopossible justification for their actions;despite even themost exaggeratedconcernsaboutthearbitrageinpriceinrespectofsomecommodities.Gibraltaralsosuffersfromundeclaredimports;butallourcontrolsareproportionalanddesignedtoavoidcausingnuisancetopeoplecrossingthefrontierbetweenournations.

In taking disproportionate action, Spain stifles business, damages trade and embittershumanrelations;shemanagestomakefamilylifefraughtwithstressforthosewhohavetocrossthefrontiertoworkorjusttoseelovedones.AlmosteverydayweseeSpanishstatevesselsofitsnavyorGuardiaCivilmakingillegalincursionsintoourterritorialsea–somethingwhichisworsenowthanitwas50yearsago!Ihavenodoubtthat,oneday,amoremodernSpanishadministrationwilllookbackonsuchbehaviourwithdeepregret.Indeed, such measures do nothing to enhance the reputation of Spain in seekingtemporarymembershipoftheSecurityCouncil.SoletuslookatwhatitisyoucandotohelpusundertheCharter,theDeclarationandtheresolutions.Well,MrChairman,youdohavejurisdictiontovisitGibraltar;therulesallowyoutodothat.The United Kingdom, the “Administering Power” under your quaintly outdatednomenclature,hasinvitedyou.We,thecolonialpeoplehaverepeatedlyinvitedyou.Butyouhavenotcome.IfyouwanttobeabletosaytomeandthepeopleofGibraltarthatyouareatleastdoingwhatyouhavepowertodo;atleastcometovisitGibraltar.YoualsoclearlyhavejurisdictionasaUNNGOtoopineorseekanAdvisoryOpiniononthe progress towards a sufficient measure of self‐government of the people of eachterritory.Wehavepreviouslyleftcopiesofour2006ConstitutionwiththisCommittee.Butyouwillnotanswerourrepeatedcall foranopiniononwhether thatConstitutiondeliverstousasufficientmeasureofselfgovernmentshortofindependencesothatwemight seek to freely determine and consolidate our status under that Constitution asbeing our choice of tailor made Fourth Option for decolonisation as introduced byGeneral Assembly Resolution 2625(XXV) of 24th October 1970.Youhavepowertodothat.Weaskyoutodoso.Butyouneitheropinenordoyouseekanadvisoryopinion.

Thisweek,ayoungSpanishPrincewithaninternationaleducationwillbecomeKing.To Felipe the Sixth of Spain, Gibraltar offers a hand of friendship and respect asneighboursandsupportersofdemocracy.This new Head of State must know that we seek only peace, understanding and co‐operation.Letusneverfallforthenegative,destructiveforceoffutileandpurilenationalismwhichfeedsno‐onebutthedinosaurswhoprefertore‐runthelonglostbattlesofyesterday.Letusprioritisedialogue.WeremainstronglycommittedtotheTRILATERALprocessofdialogue,astheUnitedKingdomhasalsorepeatedlysaiditis.Letusgrabopportunitiesforsuchdialogueinamannerthatdoesnotcompromiseanyattendantparty.ForeignSecretaryHagueoftheUnitedKingdomhasbeenimaginativeinseekingtoavoidthepitfalls of lateralismbyproposing aparallel ad hocdialogueonmatters ofmutualinterest, where the parties present would be those with relevant Constitutionalcompetences.Alongsideourcallfordialogue,MrChairman,thisCommitteeshouldsupportthepeopleofGibraltarinallourendeavoursinseekingourfinaldelisting.Supportuswiththethingsthatareinyourpower:avisit;attendanceatoursymposium;organisationofoneofyournextseminarsinourterritory;orevenbyseeking–atlast‐anAdvisoryOpinionfromtheICJonourrighttoselfdetermination.Support us because THAT is what you are created to do – or tell us why you won’twithoutpretendingthatyoucan’t.
