Eugene teens' climate change lawsuit goes before Lane County judge

A Lane County judge will hear arguments today in the case of two Oregon teens who sued the state for failing to act on climate change.

Kelsey Juliana and Olivia Chernaik, both of Eugene, filed suit in 2011, arguing that the Oregon government's failure to follow through with its pledge to reduce greenhouse gas emissions by 75 percent below 1990 levels by 2050 constitutes a violation of the public trust doctrine.

The doctrine holds Oregon's waterways and submerged land as a public resource that must be protected for future generations. The teens' lawyers argue those protections should extend to all natural resources, including the air. Efforts so far to address greenhouse gas in Oregon's air have been insufficient to protect future generations from the catastrophic impacts of climate change, the teens argue.

Juliana and Chernaik filed their suit with the help of Our Children's Trust, a national group that addresses climate change as a threat to the world's children. The group has pursued similar lawsuits across the nation, but the Eugene teens' case has garnered national attention as the first to make major strides in court.

The Oregonian will be at the hearing, listening as state attorneys and the teens' lawyers argue their case to Lane County Circuit Court Judge Karsten Rasmussen. The hearing is scheduled to begin at 2:30 p.m. Check Oregonlive this evening for updates.
