Artículo 45 CLP: Cumplimiento a nivel comunitario.


1. Los Estados miembros designarán los organismosresponsables de recibir, de los importadores y usuariosintermedios que comercialicen mezclas, la informaciónpertinente, en particular, para la formulación de medidaspreventivas y curativas, en particular para la respuestasanitaria en caso de urgencia.

In accordance withAnnex II of REACH regulation, references to emergency information services shall be provided in Section 1.4 of the Safety Data Sheet (SDS). In France, you will find below the emergency number to be indicated in section 1.4 of the SDS:

This telephone number gives contacts of all French poison centers ("centres anti-poison et de toxicovigilance"). These information centers provide you with free medical advice (except the cost of call), 24 hours a day, 7 days a week.

Décret n° 2014-128 du 14 février 2014 relatif à latoxicovigilance (article 12)

I: 01 de abril de 2014, a las mezclas clasificadas:- T+, T, C, CMR 1 y 2.-Toxicidad aguda de categoría 1, 2, y 3; STOT SE 1; STOT RE 1; CMR 1A y 1B, 1ª categoría corrosivo de la piel.

II: 01 de enero de 2016 para mezclas no cubiertos por el I y clasificado:- Senbilizantes respiratorios 1; Sensibilizantes de la piel 1; CMR 2(Comercializadas antes de 01 de enero de 2016, la declaración debe hacerse no más tarde de 30 de enero de 2016.)

III: 01 de enero de 2019, para todas las mezclas, distintas de las mencionadas en el I y II, clasificadas como peligrosas debido a sus efectos sobre la salud de conformidad con el CLP.(Comercializadas antes de 01 de enero de 2019, la declaración debe hacerse no más tarde de30 de enero de 2019.)

IV: 01 de junio de 2022, para todas las mezclas no-I, II y III, clasificado peligroso debido a sus efectos físicos de conformidad con el CLPComercializadas antes de 01 de junio de 2022, la declaración debe hacerse no más tarde de 30 de junio de 2022.

In section 1.4 of the safety datasheet (SDS) an emergency telephone numbershall be provided. This can be for example an official advisory body of themember state, where the substance or mixture is placed on the market.

Until further notice the German poison information centres do not have alegal status of an official advisory body according to Annex II section 1.4 ofthe REACH-Regulation. Therefore in Germany suppliers still have thepossibility to provide their own emergency telephone number, if for theemergency telephone service certain conditions are met: inter alia qualifiedmedical advice in emergency cases needs to be provided in German language.

The use of a German emergency telephone number in section 1.4 of the SDSis offered as a service by German poison information centres. Before makinguse of that service, suppliers have to contact and make an agreement withthe poison information centre. An agreement may include for exampleforwarding information on dangerous components or possible costs.

The BfR is responsible concerning the notification of mixtures according to §16e of the German Chemicals Act, but it does not function as poison information centre.Anyone who, in his capacity as the manufacturer or importer or who using his own trade name, places a hazardous mixture or biocide on the market must, in accordance with Chemicals Act § 16e, submit the following details to BfR:•Trade name•Details on composition•Labelling•Instructions on use•Recommendations for accidents
