WASHINGTON – During his State of the Union address, broadcast nationwide Jan. 25, President Barack Obama called for unity with Republicans, promised to generate more jobs and reduce expenses.

During the first minutes of his speech, he made reference to the Arizona shooting and highlighted that unity will bring a better nation.

“Amid all the noise and passions and rancor of our public debate, Tucson reminded us that no matter who we are or where we come from, each of us is a part of something greater ‘’ something more consequential than party or political preference. We are part of the American family.”

In his speech the president spoke about some of the priorities of his government, including tax cuts for businesses, freezing part of the federal budget, a reform to the national bureaucracy and the elimination of some projects that are important only to some voters in particular districts. He also spoke briefly about the immigration issue.

The president spoke about emerging economies like Chine and India, which are highly competitive.

He said this should encourage us to try to do more in the global market.

The president said many people remember the days when working hard were a guarantee of a lifetime job with good pay and benefits. But with the globalization of the economy, this is not feasible anymore.

“The world has changed. And for many, the change has been painful,” the president said. “The rules have changed. In a single generation, revolutions in technology have transformed the way we live, work and do business (…) The competition for jobs is real. But this shouldn’t discourage us. It should challenge us.”

Obama called the opposition to support investments in education, innovation and infrastructure.

He also announced a plan to freeze for five years the discretional expenses not related to national security, as a measure to combat the huge deficit.

His speech also included a call to invest in “tomorrow’s energy”, including wind, solar, nuclear, clean coal and natural gas.

“I’m asking Congress to eliminate the billions in taxpayer dollars we currently give to oil companies. I don’t know if you’ve noticed but they’re doing fine on their own. So instead of subsidizing yesterday’s energy, let’s invest in tomorrow’s”.

He also took on the subject of immigration, but didn’t get into much detail about it. He spoke about illegal immigration, something that he said must be dealt with “once and for all”, and ask for bipartisan support for an immigration reform.

“I strongly believe that we should take on, once and for all, the issue of illegal immigration,” Obama

said. “I am prepared to work with Republicans and Democrats to protect our borders, enforce our laws and address the millions of undocumented workers who are now living in the shadows. I know that debate will be difficult and take time. But tonight, let’s agree to make that effort. And let’s stop expelling talented, responsible young people who can staff our research labs, start new businesses, and further enrich this nation.”

The speech also made reference to a trip the president is going to make to Brazil, Chile and El Salvador during the month of March.

The Republican response to the president’s speech in Spanish was provided by U.S. Congresswoman Ileana Ros-Lehtinen, who presides the House Committee on Foreign Affairs.

She said Republicans have a firm resolution to avoid new government loans and to reduce the government spending, which is “out of control.”

“We are facing a terrible debt,” Ros-Lehtinen said about the deficit, which is now over $14 billion.

“No economy can keep these high levels or debt and taxes. The next generation will inherit a stagnant economy and a diminished nation,” making reference to the request the government made to Congress to raise the public debt limit to $14.3 billion.

“Instead of going back to basics for a solid economic growth, the president was set in creating a stimulus spending plan that not only got in the way of his promise to create more jobs, but also plunged the country into a deeper debt,” she said during the message broadcast in Spanish media.

Ros-Lehtinen didn’t mention the immigration issue in her response to the president’s speech.

WASHINGTON – En su discurso sobre el estado de la nación, transmitido a nivel nacional el 25 de enero, el presidente Barack Obama convocó a la unidad con los opositores republicanos, prometió generar empleos y reducir el gasto.

En los primeros minutos de su discurso, el presidente abordó el tema del tiroteo en Arizona, y destacó la unidad en beneficio de una mejor nación.

“Entre el ruido y las pasiones y los rencores de nuestro debate público, Tucson nos recordó que no importa quiénes somos o de dónde venimos, cada uno de nosotros es parte de algo más grande – algo con más consecuencias que un partido o preferencia política. Somos parte de la familia americana”.

Durante su discurso, el presidente habló sobre algunas de sus prioridades de gobierno, incluyendo el recorte de impuestos a las empresas, la congelación de parte del gasto federal, hacer una reforma a la burocracia nacional y la eliminación de algunos proyectos que solo son importantes para algunos electores en distritos específicos. También mencionó brevemente el tema de los indocumentados.

En el informe el presidente habló de las economías emergentes como China y la India, que son altamente competitivas. Algo que debería alentarnos a tratar de ser más competitivos en el mercado mundial.

El presidente dijo que muchas personas recuerdan los días cuando trabajar duro significaba un empleo de por vida con buen salario y beneficios. Con la globalización, esto ya no es una realidad.

“Ese mundo ha cambiado, y para muchos el cambio ha sido doloroso”, dijo Obama. “Las reglas han cambiado. En una sola generación las revoluciones en tecnología han transformado la manera en que vivimos, trabajamos y hacemos negocios (…) la competencia por empleos es real. Pero esto no debería desalentarnos. Debería

desafiarnos”.Obama hizo un llamado a la oposición para que

apoyen la inversión en educación, innovación e infraestructura.

También anunció un plan para congelar por cinco años los gastos discrecionales no relacionados con la seguridad nacional, como medida para combatir el gigantesco déficit del gobierno estadounidense.

En su discurso también llamó a la inversión en la “energía del mañana”, incluyendo energía solar, eólica, nuclear, carbón limpio y gas natural.

“Le estoy pidiendo al Congreso eliminar los miles de millones de dólares en dinero de los contribuyentes que le estamos dando en la actualidad a las firmas petroleras. No sé si lo notaron, pero a ellas les está yendo muy bien por su cuenta”, dijo Obama. “Así que en vez de subsidiar la energía del pasado, invirtamos en la del futuro”.

También habló sin mucho detalle sobre el tema de inmigración, en particular sobre la inmigración ilegal, algo que, dijo, debe resolverse “de una vez por todas”, además de que pidió un esfuerzo bipartidista para la reforma.

“Creo firmemente que debemos encarar, de una vez por todas, el tema de la migración ilegal”, dijo el presidente. “Estoy preparado para trabajar con los republicanos y demócratas para proteger nuestras fronteras, hacer cumplir nuestras leyes y ocuparnos de los millones de trabajadores indocumentados que actualmente viven en las sombras”.

El mandatario pidió al Congreso trabajar unidos para sacar una reforma migratoria adelante. “Sé que el debate será difícil y tomará tiempo. Pero esta noche, pongámonos de acuerdo en hacer ese esfuerzo. Dejemos de expulsar a personas jóvenes, responsables y con talento que pueden trabajar en nuestros laboratorios, empezar nuevos negocios y enriquecer aún más esta nación”.

El discurso también incluyó referencias a un viaje por Latinoamérica que tiene planeado para

el mes de marzo y que le llevará a Brasil, Chile y El Salvador.

La respuesta republicana en español al informe del presidente la dio la legisladora Ileana Ros-Lehtinen, quien preside la Comisión de Asuntos Extranjeros de la Cámara de Representantes.

Ella aseguró que los republicanos tienen la firme decisión de evitar nuevos préstamos del gobierno y reducir el “exagerado” gasto gubernamental.

“Nos enfrentamos a una deuda aplastante” dijo la representante cuyo distrito está en el sur de Florida, sobre la deuda pública que ya supera los 14 billones de dólares.

“Ninguna economía puede mantener esos altos niveles de deuda e impuestos. La próxima generación va a heredar una economía estancada y una nación disminuida”, agregó, haciendo referencia a la solicitud que hizo el gobierno al Congreso de aumentar el límite de la deuda pública a 14.3 billones de dólares.

“En vez de restaurar lo fundamental para un sólido crecimiento económico, el presidente se empeñó en un plan de gastos de estímulo que no sólo le impidió cumplir su promesa de crear más empleos, sino también hundió al país en una deuda mayor”, dijo durante su mensaje transmitido por los medios en español.

La representante no incluyó el tema de la inmigración en su respuesta al presidente.

AURORA – En la segunda parte de la entrevista con el abogado de inmigración David Richmond, hablamos sobre cómo las personas son transferidas a la custodia de inmigración, así como de las fianzas para salir de los centros de detención. Esta semana la entrevista trata sobre la información proporcionada en el Aviso de Presentación y los procedimientos de la corte de inmigración.

UNA VOZ: Usted hizo mención del Aviso de Presentación. ¿Por qué es importante este documento?

DAVID RICHMOND: La Oficina de Inmigración y Aduanas, ICE, emite el documento llamado AVISO DE PRESENTACIÓN (Notice to Appear or N.T.A. en inglés) cuando alguien está detenido.

EL NTA es considerado como el documento en el que el gobierno de los Estados Unidos describe sus cargos y por qué cree que usted debe ser removido de los Estados Unidos. El NTA tiene tres opciones:

Una opción es si usted es un extranjero que está llegando; la opción número dos es si usted es un extranjero presente en los Estados Unidos que no ha sido admitido o puesto en libertad condicional; y la tercera opción es si usted ha sido admitido en los Estados Unidos pero es deportable por las razones que enumeran abajo.

Un extranjero que recibe un aviso de presentación y que acaba de llegar, se lo dan generalmente en la frontera o en los aeropuertos, cuando llegan a los Estados Unidos.

Si usted ha estado en los Estado Unidos pero no ha sido admitido o puesto en libertad condicional, si su aviso tiene esta opción seleccionada, esto significa que usted entró a los Estados Unidos sin autorización legal.

La tercera opción, que usted ha sido admitido en los Estados Unidos pero es deportable por las razones que ellos enumeran, se aplica a residentes permanentes legales que típicamente están sido acusados de algún tipo de crimen.

UV: ¿Qué otra información se encuentra en el NTA?DR: El NTA incluirá la lista de acusaciones que ICE cree que

puede probar en contra suya. Algunas de las acusaciones incluyen: usted no es un ciudadano o nacional de los Estados Unidos; usted es nativo de un país extranjero y ciudadano de ese país; usted llegó a los Estados Unidos a un lugar o cerca de un lugar desconocido en un fecha desconocida y usted no fue admitido o puesto en libertad condicional en los Estados Unidos después de ser inspeccionado por un oficial de inmigración.

Estos son los términos típicos para alguien que ha entrado sin inspección a los Estados Unidos.

Además, incluirá una lista de cualquier cargo criminal o cualquier base para cargo criminal bajo el cual ICE dice que puede ser deportado de los Estados Unidos.

UV: ¿Qué debo hacer si recibo un aviso de presentación?DR: Es muy importante que cuando usted reciba este aviso de

presentación, que lo tenga siempre con usted y que cundo visite a

su abogado, después de que salga bajo fianza, se lo entregue a su abogado. Esto le dará una idea clara de por qué ICE está tratando de deportarlo.

UV: ¿Es este el único documento que le dan a alguien cuando es detenido por inmigración?

DR: Además del aviso de presentación, ICE emite un Aviso de Derechos y Solicitud de Disposición.

Este aviso de derechos le permitirá solicitar una de tres cosas: una es ‘Yo admito que estoy ilegalmente en los Estados Unidos y creo que no enfrento daño si regreso a mi país. Renuncio a mi derecho de una audiencia ante una corte de inmigración. Deseo regresar a mi país tan pronto como puedan hacerse arreglos para mi salida. Entiendo que puedo permanecer detenido hasta mi salida’. Esto en esencia significa que ‘me quiero regresar, solo déjenme salir’.

La segunda opción sería ‘Creo que enfrento daños si regreso a mi país. Mi caso será referido a una corte de inmigración para un audiencia’. La audiencia será basad en asilo, o como víctima en base al dictamen de las Naciones Unidas de crímenes contra tortura.

Si una persona elige solicitar asilo, tienen que solicitarlo a más tardar un año después de haber llegado a los Estados Unidos.

La tercera petición que usted puede escoger es ‘solicito una audiencia ante la corte de inmigración par determinar si puedo o no permanecer en los Estados Unidos’.

Muchas personas que han estado en los Estados Unidos por largos periodos de tiempo y tienen familiares calificados que son ciudadanos estadounidenses o residentes permanentes escogen esta opción.

UV: ¿Qué pasa si usted escoge una audiencia de inmigración?DR: Si usted escoge la opción dos o la opción tres, y solicita una

audiencia ante una corte de inmigración, usted recibirá una fecha para la corte, o una fecha de audiencia en el calendario principal, para algún momento en el futuro. En la corte de Chicago, las fechas de corte a futuro pueden variar entre dos meses y más de un año para la primera audiencia, y esa audiencia es la que se conoce como “audiencia en el calendario principal”.

UV: ¿El gobierno de Estados Unidos me asigna un abogado para mi caso ante la corte de inmigración?

DR: Las leyes de inmigración de los Estados Unidos son de naturaleza civil, por lo que el gobierno de los Estados Unidos no proporciona un abogado y usted no tiene un abogado de oficio que lo defienda en la corte de inmigración. Así que usted necesita hacer su propia investigación o encontrar a un representante legal competente que le ayude con su caso de inmigración.

UV: ¿Qué es una audiencia en el calendario principal?DR: La primera cita en la corte es considerada una audiencia en

el calendario principal. En esa fecha un juez de inmigración le va a preguntar qué tipo de alivio busca obtener de parte de la corte de inmigración.

El tipo de alivio que usted busca va a depender de los cargos que se le imputan en el aviso de presentación y de su propia situación

personal.Si la corte de inmigración cree que usted tiene un caso o una forma

de alivio, en base a lo que usted les dice, ellos van a programar su caso para una audiencia individual en el futuro.

UV: ¿Qué pasa en la audiencia individual?DR: En la audiencia individual es donde usted presenta su caso,

lleva toda su documentación, a testigos que testifiquen a nombre suyo y otra información que usted pueda proporcionar para presentar su caso ante la corte de inmigración. Ahí es donde el juez realizará la audiencia y escuchará toda su evidencia, escuchará la evidencia de Ice y determinará si usted puede o no quedarse en los Estados Unidos.

UV: ¿Debe alguien contratar a un abogado de inmigración inmediatamente después de salir bajo fianza o esperarse hasta que se acerque la fecha de la audiencia en el calendario principal?

DR: Es muy importante que si usted ha recibido una fecha para una audiencia en el calendario principal, que hable con un abogado de inmigración o representante legal tan pronto como sea posible. Aún si su caso no está programado para una audiencia en un año o más, es importante que usted hable con su abogado o asesor legal tan pronto como sea posible, ya que algunas veces existen oportunidades de buscar alivio durante ese año de espera.

En algunos casos usted puede recibir un permiso de trabajo, tarjeta del seguro social y licencia de manejo mientras espera a que pase ese año. También le da la oportunidad a su abogado de crear un plan para el tipo de alivio que usted está buscando.

UV: ¿Es realmente de suma importancia el tiempo en estos casos?DR: Algunas veces se puede llevar meses el obtener ciertos

documentos, entrevistar a posibles testigos que digan cosas buenas sobre usted y armar un plan completo para su audiencia individual, que es un juicio.

He tenido numerosas personas que han llegado a mí a lo largo de los años que dicen ‘tengo mi fecha en la corte la próxima semana’. Y lo que ellos no se dan cuenta es que yo puedo hacer un mejor trabajo representando a alguien cuando tengo el tiempo adecuado para preparar un caso bien pensado, que puede estar bien documentado, con mucha evidencia de apoyo.

Y viendo cómo la diferencia entre que usted se quede de forma legal en los Estados Unidos o sea deportado se basa en al decisión del juez de inmigración, es muy importante que usted presente el caso más sólido posible.

What’s the deal with Notices to Appear and immigration hearings?

AURORA – In the second part of the interview with immigration attorney David Richmond we talked about how people get transferred to immigration custody and bonds to get out of immigration detention centers. This week, the interview deals with the information provided in the Notice to Appear and immigration court proceedings.

UNA VOZ: You mentioned the Notice to Appear. Why is this document important?

DAVID RICHMOND: Immigration and Customs Enforcement (ICE) will issue a NOTICE TO APPEAR, or N.T.A, while someone is in detention.

The NTA is considered the charging document from the United States government and why they believe you should be removed from the United States.

The NTA has three options.One option is you are an arriving alien; option

two, you are an alien present in the U.S. who has not been admitted or paroled; and option three they have been admitted in the U.S. but are removable for the reasons stated below.

An alien who is issued a notice to appear that are an arriving alien are typically at the border or at the airports when they originally arrive in the U.S.

If you are present in the United States but have not been admitted or paroled, if they marked that box, this in essence means you entered the U.S. without legal authorization.

The third is if you have been admitted to the U.S. but are removable by the reasons stated below, pertains to lawful permanent residents who are being charged typically with some type of criminal matter.

UV: What other information is included in the NTA?

DR: The NTA will list the accusations that ICE believes they can prove. Some of the accusations are: you are not a citizen or national of the U.S.; you are a native of a foreign country and a citizen

of that country; you arrived in the U.S. at or near an unknown place on or about an unknown date, and you were not then admitted or paroled after inspection by an immigration officer into the U.S.

That is the typical terminology for someone who entered without inspection into the U.S. Additionally it will list any criminal charges, or any basis for criminal charges that ICE contends that you are removable from the U.S. for.

UV: What should I do if I receive a Notice to Appear?

DR: It is very important that when you receive this Notice to Appear, you keep it in your possession and then when you visit your attorney, after you have bonded out, to present this to your attorney. This will give your attorney a clear understanding on why ICE is trying to deport you.

UV: Is that the only document given to someone who is in detention?

DR: In addition to the Notice to Appear, ICE will then issue a Notice of Rights and Request for Disposition.

This notice of rights will allow you to request one of three things: one is, ‘I admit that I am in the United States illegally and I believe I do not face harm if I return to my country, I give up my right to a hearing before an immigration court. I wish to return to my country as soon as arrangements can be made to affect my departure. I understand that I may be held in detention until my departure.’ This in essence says ‘I want to go back home, just let me out of here.’

The second choice would be ‘I believe I face harm if I return to my country. My case will be referred to an immigration court for a hearing.’ The hearing will be based on asylum, or as a victim based on the United Nations crimes against torture.

If a person chooses to apply for asylum, they have to apply for asylum within one year of entering the United States.

The third request that you can choose is ‘I request a hearing before the immigration court to determine whether or not I may remain in the U.S.’

Many people who have been in the U.S. for

an extended period of time and have qualifying relatives who are U.S. citizens or permanent residents, choose this box.

UV: What happens if you choose to have an immigration hearing?

DR: If you choose option number two or three, and request a hearing before an immigration court, you will be issued a court date, a master calendar hearing court date, sometime in the future. In the Chicago court, the future court dates have been anywhere from two months to over one year for the first hearing and that is referred to as a ‘master calendar hearing.’

UV: Does the government assign me a lawyer to defend me in immigration court?

DR: The immigration laws of the U.S are civil in nature, therefore, the United States government does not provide you with an attorney, and you do not get a public defender for to defend you in immigration court. Therefore, you are required to research yourself or find a competent legal representative to help you with your immigration case.

UV: What is a master calendar hearing?DR: The first court date would be considered

a master calendar hearing. On that date the immigration judge would ask you what type of relief you would be seeking from the immigration court.

The type of relief you are seeking will depend on the charges that you’ve been accused of in the notice to appear and your own personal situation.

If the immigration court believes that you have a case or a form of relief, based on what you tell them, they will then set your case for an individual hearing sometime in the future.

UV: What happens at the individual hearing?DR: At the individual hearing is when you will

present your case, bringing all your documentation, witnesses to testify on your behalf, and any other information you can provide to make your case to the immigration court. That’s when the judge will have a hearing and will listen to all of your evidence, listen to all of ICE’s evidence and then determine whether you can or cannot stay in the

United States.UV: Should someone hire an immigration lawyer

right after they bond out or should they wait until their master calendar hearing is close?

DR: It is important if you have been issued a master calendar hearing to talk to an immigration attorney or legal representative as soon as possible. Even if your case is not scheduled for a hearing for even over one year, it’s important that you talk to a legal attorney or advisor as soon as possible, because sometimes there are some opportunities to seek relief during the pending year. In certain circumstances you can receive a work authorization, social security card, and drivers license while waiting that one year. Also, it will give the attorney an opportunity to come up with a game plan for the type of relief that you would be seeking.

UV: Is time really of the essence in these cases?DR: Sometimes it can take many months to

acquire certain documents, interview potential witnesses that would say nice things about you and put together a complete game plan for your individual hearing, which in essence is a trial.

WHEATON – Valerie Justice this week testified about the day she found her 16 year-old daughter stabbed and beaten in a bathtub in their Aurora town home.

She had gone through this before.

The man accused of murdering Erin Justice was Valerie’s then husband, who had been found guilty of the murder in 2006, but an appellate court overturned the sentence when confusion was raised about key blood evidence.

Prosecutors said Laurence Lovejoy of Naperville killed Erin, a Waubonsie Valley High School sophomore, to prevent her from talking about a rape accusation she made against him.

Back in March of 2004 Erin had accused Lovejoy of rape. While the family waited for DNA tests, they had devised a system to keep the teenager away from Lovejoy.

He worked the third shift and was only at Justice’s home sleeping during the day, when mother and daughter were away at school and at work.

This arrangement was not the best for everybody, as Lovejoy was putting pressure on Valerie to tell police Erin was lying about the rape accusation.

On March 27 Valerie called at 9 a.m. to make sure her daughter had gotten up, but she got no answer. The woman called the home nine times.

She left her job at a car wash to go check on her daughter. When she got to the home, the door was open and she called out for Erin.

She went up to the second floor and found her daughter in the bathroom.

“I saw my baby in the bathtub,” Valerie testified. “My first instinct was to pull her out, but I lifted her arm and realized I needed to call 911.”

A neighbor that heard Valerie’s scream called 911.

An officer described the crime scene as a place

where blood was everywhere, except the ceiling.

A former police evidence technician spent five days cataloging evidence from the home, including a bloody heel print on one tile in the corner of the bathroom. The killer had wiped out most of the surfaces in the house, but that print tied Lovejoy to the killing.

Assistant Public Defender Mark Lyon said that besides the print, prosecutors lack evidence directly linking Lovejoy to the murder. They plan to challenge the print evidence.

The retrial is expected to last several weeks.

Aurora brothers drop suit that sought to reclaim $190,000

AURORA – Two brothers dropped a lawsuit against the City of Aurora and the city’s police department, in which they sought to recuperate $190,000 in cash that were seized from them Oct. 18 during a traffic stop.

Jesus and Jose Martinez, both Aurora residents, said they had $190,040 in several duffle bags in their car and were their lifetime savings. They were on their way to their father’s house when they were stopped by police. They said they were taking the money to their father so he could pay off his mortgage and retire in Mexico.

City lawyers said the seizure of the money was part of an ongoing narcotics investigation and a Kane County Judge said on Jan. 5 that the city had reasons to keep the money.

Pat Kinally, a lawyer for the Martinez brothers, said they had filed and received a motion to voluntarily dismiss their lawsuit against the city.

Neither one of them was arrested during the October traffic stop.

The men were scheduled to go back to court on March 8 to keep fighting for their money.

A city attorney, John Murphey, said both brothers were supposed to talk in court about where the money came from.

“You have to prove it’s your money,” Murphey said. “They decided to drop their case rather than testify under oath as to where they got the money. It proves to you that people don’t carry $190,000 in packets of $100 bills for legitimate purposes. This case is over.

Murphey had said the seizure of the money was part of a narcotics investigation in which elements of the state police and the North Central Narcotics Task Force participated.

AURORA – Dos hermanos desistieron de una demanda contra la Ciudad de Aurora y el departamento de policía de la ciudad, en la que buscaban la devolución de 190 mil dólares en efectivo que les fueron incautados el 18 de octubre durante una parada de tránsito.

Jesús y José Martínez, ambos residentes de Aurora, dijeron que los 190 mil 40 dólares que se encontraban en una serie de bolsas de gimnasio eran los ahorros de toda su vida, y que ellos estaban en camino a llevar ese dinero a su padre para que pudiera pagar su hipoteca y retirarse en México.

Abogados de la ciudad argumentaron que el decomiso del dinero era parte de una investigación continua de narcóticos y un juez del Condado de Kane el 5 de enero acordó que la ciudad tenía motivos para quedarse con el dinero.

El abogado de los dos hombres, Pat Kinally, dijo que los hermanos solicitaron la desestimación voluntaria de su demanda contra la ciudad.

Ninguno de los dos hermanos fue arrestado durante la parada de tráfico en octubre.

Los hombres estaban programados a regresar a la corte el 8 de marzo para continuar su pelea por el dinero.

era en aquel entonces esposo de Valiere, quien había sido encontrado culpable del asesinato de la joven en 2006, pero cuya sentencia fue revocada por la corte de apelaciones, cuando hubo confusión sobre evidencia crucial.

Los fiscales dijeron que Laurence Lovejoy, de Naperville, había asesinado a Erin, una estudiante de segundo año de preparatoria en la escuela Waubonsie Valley High School, para evitar que ella hablara sobre una acusación de violación que había hecho contra él.

En marzo de 2004 Erin había acusado a Lovejoy de violación. Mientras la familia esperaba los resultados de análisis de ADN, crearon un acuerdo para mantener a la joven alejada de Lovejoy.

“Vi a mi bebé en la bañera”, testificó Valerie. “Mi primer instinto fue sacarla, pero levanté su brazo y me di cuenta que necesitaba llamar al 911”.

Un vecino que escuchó los gritos de Valerie llamó al 911.

Un oficial describió la escena del crimen como un lugar en le que había sangre por todas partes, excepto en el techo.

Un ex técnico de evidencia de la policía pasó cinco días recopilando evidencias en la casa, incluyendo una huella sangrienta de un talón en un azulejo en una esquina del baño. El asesino había limpiado casi todas las superficies de la casa, pero esa huella ligaba a Lovejoy con el asesinato.

El defensor de oficio Mark Lyon dijo que además de la huella, los fiscales no tienen evidencia alguna contra su cliente. Además, mencionó que planean pelear la inclusión de la huella como evidencia.

El segundo juicio por el asesinato se espera que dure varias semanas.

BOGOTA – Una explosión en una pequeña mina subterránea en el noroeste de Colombia dejó cuando menos 20 trabajadores muertos, dijeron oficiales del país.

Colombia, el quinto país exportador de

carbón, tiene una industria dominada por empresas grandes y minas al aire libre, pero también cuenta con pequeñas minas subterráneas en la parte central del país, donde acumulaciones del gas metano pueden causar accidentes. La explosión se registró en la mina “La Preciosa”, ubicada a un hora de Sardinata

en al provincia de Norte de Santander, el 26 de enero.

En una entrevista con la agencia de noticias Reuters, Marisa Fernandez de Ingeo Minas dijo que “me acaban de informar que hay 20 muertos y seis heridos”.

Oficiales locales dijeron que habían podido recuperar cinco cuerpos hasta el momento, y seis personas heridas.

“Espero que (Dios) me favorezca con otro tipo de trabajo para mantener a mi familia, no este tipo de minería en una mina asesina”, dijo un minero no identificado a una estación de

televisión.Medios locales informaron que ya se habían

registrado otras explosiones en esa misma mina en el pasado.

El alcalde del municipio de Sardinata, Yamile Rangel, dijo que 16 personas se encontraban atrapadas en la mina, pero oficiales de la Cruz Roja dijeron que había pocas probabilidades de encontrarlos con vida.

Las autoridades no están seguros de cuántos mineros estaban en al mina porque la explosión sucedió a las 6:30 a.m. del 26 de enero, justo al cambio de turno.

35 people die in suicide bombing in Moscow

MOSCOW – 35 people died and at least 180 were injured when a suicide bomber activated an explosive in Moscow’s busiest airport Jan. 24.

Nobody has claimed responsibility for the explosion, occurred at the Domodedovo Airport, but Islamic militants in the southern region of Chechnya have been blamed for previous explosions in Moscow.

Russian President Dimitry Medvedev described the bombing as a terrorist attack and immediately tightened the security at the other two commercial airports in Moscow and other transportation hubs.

The spokesperson for the Investigation Committee, Vladimir Markin, said the attack was probably carried out by a suicide bomber and they were “trying to identify him,” adding that the suicide bomber apparently carried the explosives in a belt.

The explosion happened at 4:32 p.m. local time, when hundreds of passengers and employees were in a lightly secured area of the terminal. They were sprayed with shrapnel and ball bearings, designed to cause the most damage.

The terminal was filled with black smoke and witnesses described a scene of horror.Of the 180 people injured, officials said 117 were still hospitalized, 21 of them in serious

condition. The Civil Defense Ministry said all the victims of the explosion had been identified but declined to make comments about the suicide bomber.

The incident has caused several men to get fired. Medvedev fired a high-ranking official with the Department of the Interior for the lax security at the airport that probably enabled the terrorist to carry out the Jan. 24 attack.

It is said that other officials have been fired as a consequence of the attack.On Jan. 26, Russia held a national day of mourning in honor of the deceased. Flags were

flying at half staff on public buildings and radio and TV stations cancelled their regular entertainment programs, substituting them with serious music. Public festivals, including a beauty contest, were cancelled out of respect.

Russian newspaper Moskovsky Komsomolez said the attacked had been planned since November, while the daily Rossiyskava Gazeta speculated that the attack was carried out in response to attacks against immigrants in the North Caucasus region.

There are speculations that the suicide bomber was a member of an Islamic group active in the southern region of Stavropol. This region is next to the North Caucasus, a region identified originally as the place where the terrorist was from. In that region numerous Islamic radical groups have been fighting for years to form an independent emirate, while Russian authorities have had a hard time to keep peace in the region, where unemployment and poverty are rampant.

BOGOTA – An explosion in a small underground mine in northeast Colombia left at least 20 miners dead, officials said.

Colombia, the fifth coal exporter in the world, has an industry dominated by large companies with open air excavations, but also smaller mining operations in underground mines, where build up of methane gases can cause accidents.

The explosion was registered at “La Preciosa,” a mine located an hour from Sardinata in the Norte de Santander province, on Jan. 26.

During an interview with Reuters, Marisa Fernandez of Ingeo Minas said “They’ve just

told me there are 20 dead and six wounded.”Local officials said they had recovered five

bodies and six injured men.“I hope (God) favors me with another type

of job to support my family, not this kind of mining in a murderous mine,” an unnamed miner told a local television station.

Local media said there have been other explosions at that same mine in the past.

The mayor of the municipality of Sardinata, Yamile Rangel, said that 16 people were trapped inside the mine, but Red Cross officials said there was little hope they could be rescued alive.

Authorities are not sure how many miners were in the mine, as the explosion occurred at 6:30 a.m. during the change of shifts.

CD. DE MÉXICO – Altos oficiales del gobierno mexicano negaron que se hubiera dado autorización al Buró Federal de Investigaciones (FBI) de los Estados Unidos para interrogar a migrantes en territorio mexicano.

Salvador Beltrán del Río, comisionado del Instituto Nacional de Migración (INM), rechazó la idea de que oficiales del FBI estuvieran interrogando a migrantes indocumentados, particularmente de Centroamérica, que habían sido detenidos.

El oficial dijo que la información era falsa y que no había agentes estadounidenses interrogando a los migrantes.

La información salió a la luz el fin de semana del 22 y 23 de enero, cuando el periódico El País publicó información proporcionada por Wiki Leaks en su sitio de Internet.

De acuerdo con el periódico, el Centro para Investigación y Seguridad Nacional (CISEN) había autorizado al FBI y a otras agencias de seguridad para que interrogaran a migrantes indocumentados.

Un documento enviado por al Embajada de Estados Unidos en México al subdirector del FBI, John S. Pistole en 2008 dice que “el CISEN, que es nuestro principal interlocutor en la lucha antiterrorista, ha permitido a funcionarios del gobierno de Estados Unidos entrevistar a los extranjeros detenidos en los diferentes centros de detención desplegados por todo el país para recabar potencial información sobre terrorismo.”

En ese mismo documento se indica que los inmigrantes son sujetos a un sistema que los detiene y los libera.

“En lugar de concentrar a los detenidos [inmigrantes indocumentados] en una instalación cerca de la capital, las autoridades migratorias detienen y liberan a los detenidos en el mismo lugar donde los encontraron”.

El 24 de enero senadores del PRI y del PRD dijeron que le Senado debería exigir una explicación al gobierno federal sobre este asunto.

El senador por el PRI, Francisco Labastida, dijo que esta era una invasión a la soberanía autorizada por el gobierno de México. Abundó que si se comprobaba que las acusaciones eran verídicas, mostraría que la disposición del actual gobierno federal es de quedar bien con Estados Unidos y no respetar las leyes, las facultades y los derechos de un país.

Durante una breve entrevista en Los Pinos el 26 de enero, Beltrán negó que estas acusaciones fueran ciertas.

MEXICO CITY – High-ranking officials in Mexico denied they gave authorization to Federal Bureau of Investigation (FBI) officials to interrogate migrants in Mexican soil.

Salvador Beltran del Rio, Commissioner with the national Migration Institute (INM) rejected the notion that FBI officials were interrogating undocumented migrants, particularly those from Central America, who were detained.

The official said the information was false and that there were no U.S. agents interrogating migrants.

The information first came to light over the Jan. 22-23 weekend, when El Pais newspaper published information provided by Wiki Leaks on its Web site.

According to the newspaper, the Center for Investigation and National Security (CISEN) had authorized FBI and other security agencies to interrogate undocumented migrants.

A document sent by the U.S. Embassy in Mexico to FBI Deputy Director John S. Pistole in 2008, states that “CISEN, which is our main partner in the fight against

crime, has allowed officials from the U.S. government to interview foreign nationals detained in the different detention centers throughout the country, to obtain possible information about terrorism.”

The same document states that immigrants are subject to a “catch and release system.”

“Instead of concentrating the detainees (undocumented migrants) at one facility in near the capital, migration authorities arrest and release the detainees at the same place where they were found.”

On Jan. 24, PRI and PRD Senators said the Senate should demand an explanation from the Federal Government about this matter.

PRI Senator Francisco Labastida said this is an invasion of sovereignty authorized by the Mexican government. He said if these accusations were proved to be true, it would show the Mexican government’s disposition to be on the U.S.’ good side and its disposition to forget about the laws, faculties and rights of a country.

During a brief interview at Los Pinos Presidential Residence on Jan. 26, Beltran denied the accusations were true.

MÉXICO – Miembros de la Policía Federal decomisaron más de 73 kilos de cocaína en un retén en el estado de Chiapas, informaron autoridades el 26 de enero.

El operativo se realizó en la carretera Las Choapas-Ocozocuautla en los límites con el estado de Tabasco.

Al hacer una revisión de un tractocamión, elementos de la Policía Federal encontraron un compartimiento oculto en el toldo del camarote del a cabina, donde se localizaron varios paquetes de color negro con una

sustancia blanca que parecía cocaína.Elementos de la autoridad arrestaron al chofer de la

unidad, Enrique Duarte Gómez, de 36 años y originario del Estado de México, así como de su acompañante, José Luis Hernández Magallanes, de 37 años, de Nuevo León.

En total se encontraron 66 paquetes de droga con un peso total de 73 kilos 417 gramos.

A los detenidos también se les decomisaron cuatro teléfonos celulares de diferentes marcas, además del tractocamión en el que viajaban.

MEXICO – Federal Police officers seized over 73 kilos of cocaine at a checkpoint in the state of Chiapas, authorities said Jan. 26.

The operation took place on the Las Choapas-Ocozocuautla road in the limits with the state of Tabasco.

When the trailer was checked out for contraband, officers with the Federal Police found a hidden compartment in the truck’s cabin, where several black

packages were found. The packages had a substance similar to cocaine.

Officers then arrested the driver, 36 year-old Enrique Duarte Gomez, from the State of Mexico, and 37 year-old Jose Luis Hernandez Magallanes, from Nuevo Leon.

Authorities seized a total of 66 packages with a total weight of 73 kilos 417 grams.

They also seized four cellular phones and the truck where the drug was transported.

PGR investigates death of security detail for Cd. Juarez Mayor

CD. DE MÉXICO – La Procuraduría General de la República (PGR) indagará los hechos en los que murió un escolta del presidente municipal de Ciudad Juárez, Chihuahua, Héctor Murguía.

En un comunicado de prensa emitido por la Secretaría de Seguridad Pública (SSP) federal, se informó que el Ministerio Público de la Federación se hará cargo de las investigaciones para determinar cómo se suscitaron los hechos y deslindar responsabilidades.

En el comunicado se indica que se encuentran bajo custodia de la Delegación Estatal de la Procuraduría General de la República cuatro elementos de la Unidad de Reacción Inmediata que estuvieron involucrados en la muerte del escolta.

Alrededor de las 9:30 p.m. del martes 25 de enero elementos de la Policía Federal que se encontraban en el hotel Santa Fe de Ciudad Juárez recibieron el reporte de un taxista, quien les informó que gente vestida de civil y armada estaba parada dos cuadras de distancia, por lo que los elementos realizaron una revisión de la zona.

El comunicado indica que al llegar al lugar, los elementos de la PF encontraron a varias personas con armas largas, a quienes les dieron órdenes de bajar sus armas. Estas personas, de acuerdo con la declaración de los ofíciales, no hicieron caso y adoptaron una actitud ofensiva al dirigir su armamento contra los policías federales, quienes reaccionaron disparando contra el elemento que perdió la vida unos minutos más tarde.

De acuerdo a la información de la SSP, los elementos de seguridad del edil vestían de civil y no acataron las órdenes de las autoridades federales. El fallecido era un policía municipal, Jorge Humberto Muñoz Pérez, de 29 años de edad, asignado al equipo de seguridad del presidente municipal.

Mientras tanto Héctor Murguía, dijo que los policías federales “le dispararon arteramente” a su escolta.

El edil dijo que los federales llegaron a la casa del sacerdote Hesiquio Treviso “diciéndoles groserías” a sus guardias personales y “les dijeron que bajaran sus armas. Bajó su arma, alzó las manos y ahí fue cuando le dispararon arteramente”.

El alcalde mencionó que sus escoltas se identificaron, contradiciendo lo dicho por la SSP.En una entrevista con Carlos Puig en W Radio, el edil dijo que “este no es un hecho aislado”,

ya que ha tenido otros incidentes de tensión con ese cuerpo policiaco.Sin embargo, descartó pedir que la Policía Federal salga de este municipio.“No, lo más irresponsable es hacer eso. Lo más importante ahorita es tener prudencia”, dijo.

CD. DE MÉXICO – Setenta y cinco personas, entre ellos tres mujeres, quienes aparentemente eran detenidos contra su voluntad en un centro de rehabilitación contra el alcohol en la Ciudad de México, fueron rescatados por autoridades el 25 de enero.

La Procuraduría de Justicia del Distrito Federal informó que la Comisión de Derechos Humanos del Distrito Federal había pedido su ayuda.

Oficiales llegaron al Centro de Rehabilitación para Alcohólicos “Aprendiendo a Vivir”, donde encontraron a 72 hombres y tres mujeres “en malas condiciones de salud, hacinamiento e insalubridad”.

Todos ellos tenían dermatitis y tres

muestran lesiones recientes.“Todos ellos dormían en un cuarto de

cinco por cinco metros, unos encima de otros. Varios de ellos refirieron que se encontraban en este lugar en contra de su voluntad”, dijeron oficiales.

Cada uno pagaba alrededor de 20 dólares al mes y tenía que proporcionar una despensa cada semana.

Durante el operativo las autoridades arrestaron a dos hombres, Luis Genaro García Álvarez, de 32 años, y presidente del centro de rehabilitación; y a Juan Carlos Hernández Luna, de 40, uno de los encargados del lugar, a quien se le investiga por secuestro.

Las víctimas fueron trasladadas a la Subprocuraduría de Atención a Víctimas y Servicios a la Comunidad, donde recibirán tratamiento médico y psicológico.

MEXICO CITY – The Mexican Attorney General (PGR) will investigate the facts surrounding the death of a bodyguard who was assigned to the security detail of Ciudad Juarez Mayor, Hector Murguia.

In a press release issued by the Department of Public Safety (SSP,) it was informed that federal prosecutors will be in charge of the investigations to find out how things happen and who is responsible for the man’s death.

The release states that four men are in custody of the State’s Attorney General. These men were assigned to the Immediate Response Unit and were involved in the death of the security officer.

At about 9:30 p.m. Jan. 25, Federal Police officers were at the Santa Fe Hotel in Ciudad Juarez when they received a call from a taxi driver, who informed them that men dressed in plain clothes and carrying weapons were standing about two blocks fro their location, and officers decided to check the zone.

The release indicates that when the officers arrived at the site they found several men with long weapons, and ordered them to surrender them. These men, according to statements from the officials involved, didn’t obey their orders and took and offensive approach, leveling their guns at

the Federal Police officers, who reacted to the threat firing their weapons and mortally wounding the man who died minutes later.

According to information provided by SSP, the men in security detail for the Mayor were dressed in plain clothes and didn't follow the orders from the federal officers. The deceased, Humberto Muñoz Perez, 29, was a municipal police officer assigned to the Mayor’s security detail.

Meanwhile Murguia said that federal officers “artfully shot” his bodyguard.

The mayor said federal officials arrived at the home of priest Hesiquio Treviso “yelling bad words” to his security detail and “they were told to lower their weapons. He lowered his weapon, put his hands on the air and that’s when they artfully shot him.”

The Mayor said his security detail identified themselves, something that contradicts what federal officials have said.

In an interview with Carlos Puig in W Radio, the Mayor said that “this is not an isolated incident,” and that he has had other incidents with that same law enforcement agency.

However, he rejected the idea of demanding the Federal Police retreat from the city.

“No, that would be the most irresponsible thing to do. What’s most important now is to be cautious,” he said.

MEXICO CITY – Seventy five people, among them three women, who allegedly were held against their will at an alcohol rehabilitation center in Mexico City, were rescued by authorities Jan. 25.

The Mexico City Attorney General Office informed that the Mexico City Human Rights Commission had requested their help. Officials arrived at the “Learning to Live” Alcoholism Rehabilitation Center, where they found 72 men and three women “in poor health, in overcrowded and unhealthy conditions.”

All of them have dermatitis and three of them have recent lesions.

“All of them slept in a room five meters by five meters, ones on top of the others. Several of them said they were at that place against their will,” an official said.

Each one paid about 20 dollars per month and had to provide items for the food pantry each week.

During the operation authorities arrested two men, Luis Genaro Garcia Alvarez, 32, the president of the rehabilitation center, and Juan Carlos Hernandez Luna, 40, one of the people in charge of the place, who is being investigated for kidnapping.

The victims were taken to the Office for Victims and Community Services, where they will receive medical and psychological treatment.

Reenactment of accusation against Kalimba takes place

CHETUMAL – In the early morning hours of Jan. 26 Kalimba arrived at the Hotel Gran Marlon in Chetumal, Quintana Roo, where authorities reenacted the accusation against the singer.

Handcuffed and wearing the orange pantsuit from the Chetumal Correctional Center, Kalimba arrived at the hotel at 5:30 a.m. His demeanor was serene while he was talking to his lawyers and checking the facilities along with his lawyers, experts and authorities, including Judge Daniel Farah Godoy.

Kalimba was charged with raping a 17 year old girl named Diana in one of the hotel’s rooms.

The reenactment took place without the victim being present.When rumor spread that the singer was at the hotel while the reenactment was taking

place, some fans appeared in the area with signs while yelling their support to their favorite artist.

At press time the judge was about to decide, based on evidence presented, if he was going to send Kalimba to jail or let him go.

CHETUMAL – La madrugada del 26 de enero llegó Kalimba a las instalaciones del Hotel Gran Marlon de Chetumal, Quintana Roo, donde se realizó la reconstrucción de los hechos de la acusación contra el cantante.

Esposado de las manos y vestido con el uniforme anaranjado de los presos del Centro de Readaptación Social de Chetumal, Kalimba llegó al hotel alrededor de las 5:30 de la mañana. El cantante fue captado con un aspecto sereno, mientras explicaba y recorría las instalaciones en compañía de sus abogados, así como de los peritos y autoridades correspondientes, además del juez Daniel Farah Godoy.

Kalimba fue acusado de violar a una joven de 17 años de nombre Daiana el pasado 19 de diciembre en una de las habitaciones del hotel.

La reconstrucción de los hechos se realizó sin que la parte acusadora estuviera presente.

Cuando se corrió la voz de que la reconstrucción de los hechos estaba llevándose a cabo, algunos admiradores del cantante se aparecieron en el lugar con pancartas y gritando porras de apoyo a su ídolo.

Al cierre de esta edición se esperaba que el juez diera de un momento a otro si dictaba auto de formal prisión a Kalimba o lo dejaba en libertad, después de estudiar las pruebas.

El conductor de televisión chileno Don Francisco ha sometido a la corte los documentos necesarios en referencia a la demanda de paternidad que entabló Patricio Flores Mundaca, quien alega ser hijo ilegítimo del conductor.

Mediante un comunicado de prensa Mario Kreutzberger dijo que sus abogados habían proporcionado todos los documentos e información necesaria para aclarar la situación.

Mientras tanto, él pidió comprensión a los medios de comunicación y a sus seguidores, diciendo que “cumpliendo el carácter de reserva que solicitan los Tribunales de familia, me abstendré de emitir cualquier información o apreciación

adicional, y lo mismo he instruido a mis abogados”.

En los primeros días de 2011 un hombre llamado Patricio Abraham Flores Mundaca dijo ser el fruto de una relación fugaz entre su madre y Mario Kreutzberger, la cual se llevó a cabo en 1967, pero que él se había enterado de la verdad hasta junio de 2010, cuando la mujer le confesó la verdad mientras estaba gravemente enferma.

A pesar de que Flores Mundaca había dicho que no quería dinero como resultado de la demanda, medios de comunicación en Chile informaron dos días después de que la demanda fue interpuesta, que el hombre pasaba por problemas financieros.

El Tercer Tribunal de Familia de Chile ha programado una audiencia para el 1 de febrero.

Chilean TV personality Don Francisco has filed in court the documents necessary pertaining to a paternity suit filed against him by Patricio Flores Mundaca, who alleges he is his illegitimate son.

Through a press release, Mario Kreutzberger said that his lawyers had provided all the documents with all the information to clarify the situation.

Meanwhile, he asked for understanding from the media and his fans and said that “fulfilling the requests by the Family Tribunal, I will refrain from making any more comments or providing more information,

and I have instructed my lawyers to do the same.”

In the first days of 2011 a man named Patricio Abraham Flores Mundaca said he was the fruit of a brief relationship between his mother and Mario Kreutzberger in 1967 and that he only found out the truth in June of 2010, when the woman had confessed him the truth while being gravely ill.

Even though Flores Mundaca has said he doesn’t want any money from the lawsuit, a couple of days after the lawsuit was filed Chilean news media broke the news that the man was going through financial hardship.

A hearing before the Third Family Tribunal in Chile has been scheduled for Feb. 1.
